Question of chlorophyll: April 2008
Hello!
I have a quick question, here is an example: when I film a marathon, standing near the speakers and thus parts of the course, played music of the DJ's in the video. If I have to pay royalties if I use the portal to upload a video? The music is now played there once was and is synonymous heard several 100 meters, so I can not renounce the whole sound. What is there legally from? It goes to Austria.
Thanks ever!

if the "accidentally" recorded music is not mandatory part of your video's, you should have no problems with it. If, however, without the music is missing something (if you are as a band at concert films, synonymous only during a pan), then the music has absolutely necessary and you need the rights, etc.. (so it was at least in the digital section explains trade fair in Munich)

That sounds logical. Vorallem is 60% of the time anyway to hear the moderator and not the music. Thanks again!

Here is the legal position relating to "When is immaterial Music, royalty-free accessories?" Assessment in Detail: ... Interesting, but overall a bit (too) vague (why else is the info on a website for a law firm?). Could be tantamount to a case where it would create a thing.
My Info looked so far like this:

@ Markus: The Uterschied is that I as an event with absolutely no way I have the time and the music in the background, or choose to leave off. Since the best run straight past all the clapping and yelling loudly, but these noises are simply about the music and I would without special software and a lot of time filter can not synonymous. A little confused, I am now still. But of course I think synonymous: There are tens of thousands of such videos on the net, not that which is now a reason would be that it is allowed ...

I am not a lawyer. If you need more security, perhaps the advice of an Austrian lawyer is not wrong.
