Question of rundabout: Juli 2009
Moin moin liebe Filmmakers,
I want to use for a commercial project NOT a track on the background of Airborne. Now I've already checked in the database, Gema and found nothing like that ...
Give any other Lizenseintreiber or can I use the track and then publish? I mean on Youtube and give the title already irgenein funny shrimp with the Movie Maker has probably images of tape to show ..
One answer would be that of the track is super super Geil ... knows her safe "Airborne - Running Wild
Regards

An old topic. Basically, it's FUCK-IT DOES NOT MATTER if you create a non-commercial film.
1.) Do you have the rights of musicians of Airborne, use the piece for your film? Moreover, you will have to share with you not to GEMA or Slashcam Forum in conjunction, but with the record company / management / distribution of Airborne. Set it up yourself at severe cost. True heavy costs. Unless you can not convince them of your personal non-commercial purposes. Perhaps then they are more forgiving.
But this is only the first part ...
2.) If you want to show the film publicly (; eg the Internet, on the playground, before your friends in the football club), then you must ALWAYS (;!!!!) ADDITION to the cost of use s.Airbourne synonymous for publication or pay GEMA fees. The "Browsing" of the film with the music costs GEMA fees. If it is not clear: The emphasis in this sentence to "ALWAYS" and "ADDITION". Understood? "ALWAYS" + "ADDITION"
GEMA This cost depends, among other things of the nature of the publication from (Language, room size, where the film will be shown before how many people etc.). I do not know in what condition the current disputes between youtube and GEMA. In addition, you should search next.
In short, you ought to look for another music for your film, because there are GEMA-free music. But beware: GEMA-free does not mean free of charge, for you must note point 1. Consequently, you need at the producers of GEMA-free music tracks buy the license to use the music. eg highland music archive, soundtaxi.net etc. From them, you will receive after the purchase waivers for the performances, which you acknowledge in writing that the songs are GEMA-free.
Of course you can ignore the two points. Maybe you're lucky. Perhaps you are synonymous for a few days after the screening of your film two letters of at least two lawyers (; 1x Music Company / Airborne, 1x PRS) in the mail box, which you confront with a very interesting euro amounts that you pay according to a case for Peter Zwegat could make.
A note: This posting is and is not intended as legal advice. You ought to for legal and Music licensing costs in your shooting with your lawyer get in touch.
You have no lawyer? Please bang 'you one.
Greeting Holger
