We recently reported on the new guidelines from the US Copyright Office ![]()
Basically, works are only protected by copyright if a human being has made the essential creative decisions in their creation – in the case of an image AI, a text prompt is not sufficient, but the source image must be transformed into the final work by means of selection processes and refinements carried out by the artist. This also means that every decision regarding copyright protection depends heavily on a case-by-case examination. However, for this examination to be carried out, it is no longer sufficient to submit the work to the Copyright Office in its final state for review; the entire work process must be documented to demonstrably show that a human being was responsible for the final appearance and made creative decisions. ![]() The source image ![]() The result Documentation of the Work ProcessAnd that is exactly what Kent Keirsey did: using a video, he documented all the steps necessary to create his dadaistic-looking image "A Slice of American Cheese". In this case, generating an image via AI and then refining it in several steps using in- and outpainting. This proof was sufficient for the Copyright Office to determine a sufficiently large human contribution and thus grant the copyright. The work, created in just 10 minutes, was also created precisely to demonstrate how little human intervention is necessary to meet the Copyright Office&s requirements. AI Art Can Now Be Commercially ExploitedKent Keirsey did not create this precedent entirely selflessly, as he is the CEO of the platform ![]() For artists and companies, this precedent is a milestone, as it shows the way in which AI-generated works can obtain copyright protection and thus be commercially exploited. Providers of AI tools will probably soon introduce a similar logging function to Invoke.
