Frage von Cyclops:

Hello,

I just shoot a film parody and would like to see as the real film about the shooting. Of course, it is not allowed, the Music of CDs ... to take. As it is, if I:

- The melody / Score yourself based on the scores games

- Or do I need to distort the sound, convert ... So a variation, so that I do royalty-free and with full rights to use? It should, however, from my score to the model still hear.

Antwort von Andreas_Kiel:

Once the film is based heavily s.Vorbild (and after what you write is indeed desirable) that would be illegal. If you have only a few recognizable bars alienation, it would be a balance thing.
It then collides with the artistic freedom to copyright, but here is more likely to expect the copyright. This can be you a lawyer specializing in media law better answer, you should be given to the the finished work synonymous imagine. Even then, of any positive information then you are still no immunity before the onset of persecution by the rights holders ...

ok so according to wikipedia and music law citation is allowed to take over passages that even APPEAR to be. Then this is not a problem so. Scores sucen, what slebst conceive, and a few passages fit.

Or have I misunderstood what da? Otherwise it would probably be very easy ...

Antwort von PowerMac:

Thou shalt not take the piece not only easy to use, but rather as a quotation.

Antwort von Andreas_Kiel:

For a film parody of the quote is right (as ever with 99.5% of all questions on the use of protected music) at least (!) Controversy, see here what you need to know in particular:
"Jusline" wrote: Partly it is proposed that the parody under the Rule of Law Citation (§ 51) and to be treated in this way to justify it. The quote does not fit right for the parody, quotes are the one wherein they are only points of a work of play, while the parody typically a plant as a whole object, but are required for citations of references in section 63 of parody and is uncommon in practice, not used.
and:
"§ 24 UrhG" wrote: (1) An independent work, which is in free use of the work of another has been created, shall not without the permission of the author of the published work and used recycled.
(2) Paragraph 1 shall not apply to the use of a work of music, through which a melody recognizable from the factory and a new plant is used.

Read times in which the contribution osverlinkten paragraph "IV parody and free use." The odds are for the use of foreign works in a parody is not bad, but: "However, there is always a balance in individual cases provided."
What does it all mean in practice?
You will advance your projects do not require authorization for use of the material received. This means that balance (which weighs heavier: Your freedom than parodistic or copyright) then in case of dispute, the court made. The dispute is immense and your legal expenses will be very likely for copyright infringement to cover refuse. Can and do you do this?
If you take the chance to be your parody at a very high artistic level. This increases your chances in court in case of disputes. To Specialist You will not be around then anyway, so the question before.
